Last year, our condo community discovered that the developer had granted consent to only 50% of the owners and not all of us. Apparently they oversold their units without allocating bumi lots. So those of who didn't get consent are automatically deemed as bumi lot. They then wound up. The proprietor recently also wound up. The liquidator taking over from proprietor sent us a letter stating a very hefty penalty for transfer. Seeing that our SPA doesn't state anything abt bumi lots or penalty & all our lawyers didn't find any issue when purchasing, what steps can we take to get the penalty waived?
